Aproximación a los factores incidentes en la responsabilidad extracontractual del Estado, a causa del acto médico oficial y de las instituciones de salud en Colombia

The liability of the state, is supported by article 90 from the National Constitution, with the core figure of the unlawful damage, which can be caused by acts or omissions by public authorities, creating an obligation for reimbursement of a monetary nature of assistance to the Colombian nation. This kind of responsibility has a strong presence in the public health sector where they cause extensive damage to medical users of general health system, a product of various situations within the service, such us medica! care health center on an individual basis, the provision of a collective patient safety in hospitals and public clinics, the medical procedure or technique, the transgression of the rights of the patient, the surgical oblitas, prescription and medical care of patients in ambulances.
